1. Overview

Welcome to ConnectEngine OS, an AI-powered business automation platform operated by ConnectEngine LLC (“we,” “us,” or “our”). By accessing or using our service at app.connectengine.net, you agree to be bound by these Terms of Service.

ConnectEngine OS provides automated lead discovery (LeadFlow), AI content creation (ContentFlow), and operations monitoring (OpsFlow) for businesses, agencies, and solo founders.

2. Eligibility

You must be at least 18 years old to use ConnectEngine OS. By using our service, you represent and warrant that you:

• Are at least 18 years of age
• Have the legal authority to enter into these Terms
• Are not prohibited from using the service under applicable laws

3. User Accounts

To use ConnectEngine OS, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms or engage in suspicious activity.

4. Your Data and Content Ownership

Your Data: You retain full ownership of all business data in your ConnectEngine OS account, including leads, outreach content, and generated materials.

AI-Generated Content: Content generated by our AI (email drafts, social media posts, images) is created on your behalf and for your use. You own the output.

License to Us: By using our service, you grant us a limited license to process and store your data solely for the purpose of providing the service. We do not use your data to train AI models.

5. AI-Generated Content Disclaimer

ConnectEngine OS uses third-party AI models to generate content. ConnectEngine LLC does not control the training data or methods of these models.

No guarantee of accuracy. AI-generated content (emails, posts, lead scoring) may contain errors. You are responsible for reviewing and approving all content before it is sent or published.

No guarantee of uniqueness. AI-generated content may be similar to content generated for other users.

Your responsibility. You are solely responsible for the content you approve and send through our platform, including compliance with anti-spam laws (CAN-SPAM, GDPR) and any applicable regulations.

6. Acceptable Use

You agree not to use ConnectEngine OS to:

• Send spam, unsolicited bulk email, or violate anti-spam laws
• Harvest personal data without proper legal basis
• Generate illegal, harmful, or deceptive content
• Attempt to access other tenants' data
• Reverse-engineer or exploit our systems
• Circumvent usage limits or payment requirements
• Disrupt or interfere with the service

We reserve the right to remove content and terminate accounts that violate these guidelines.

7. Third-Party Services

ConnectEngine OS integrates with third-party services. By using our platform, you acknowledge that your data may be processed by Supabase, Anthropic, AIML API, Apify, Hunter.io, Instantly.ai, Stripe, Cloudflare, and Hetzner. Each operates under its own terms. See our Privacy Policy for details.

Bring Your Own Account (BYOA): For email sending (Instantly.ai), you connect your own account and control your sending reputation, warmup, and limits. ConnectEngine OS is not responsible for the deliverability or reputation of your email sending account.

8. Payments and Subscriptions

ConnectEngine OS uses a subscription-based pricing model:

• Plans: Starter, Growth, and Agency tiers with different usage limits
• Billing: Monthly subscriptions auto-renew. You may cancel at any time; cancellation takes effect at the end of the billing period
• Free Trial: New accounts may receive a 14-day free trial of the Growth plan. No credit card required to start
• Refunds: Generally non-refundable. Contact us for exceptional circumstances
• Price Changes: We may change pricing with 30 days notice. Existing subscriptions are honored until renewal

9. Intellectual Property

The ConnectEngine OS service, including our website, software, branding, and documentation, is owned by ConnectEngine LLC and protected by intellectual property laws. You may not copy, modify, distribute, or sell any part of our service without written permission.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, technical issues, third-party outages, or force majeure events.

11. Disclaimers

CONNECTENGINE OS IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONNECTENGINE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify ConnectEngine LLC from any claims arising from your use of the service, violation of these Terms, content you send or publish through the platform, or violation of anti-spam or data protection laws.

14. Termination

You may close your account at any time. Upon termination:

• Your right to use the service ends immediately
• Your data is retained for 30 days, then deleted
• Active subscriptions are cancelled at the end of the billing period

15. Dispute Resolution

Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within thirty (30) days, either party may submit the dispute to binding arbitration under the American Arbitration Association rules. The arbitration shall be conducted in English in Wyoming, USA.

16. Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law principles.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and changing the “Last updated” date. Your continued use of ConnectEngine OS after changes constitutes acceptance.
